Petition to close down undesirable business at no 45 Observatory ave, Observatory, Johannesburg

    We, the residents of Observatory in ward 66 Johannesburg, hereby humbly petition the city of Johannesburg for the permanent closure/recall consent to operate a lodge in the vicinity as per address: 45 Observatory avenue, Observatory, Johannesburg.

    Provision when consent is granted, clearly stipulates that such property can only be used for residential purposes and clearly this establishment has not kept to the rules.

    We, the residents of Observatory, have been subjected to abuse by this Lodge for the last few years, since they have opened.

    We feel that this establishment is not operating according to consent use rules, that this establishment has flaunted the laws, and has created a toxic and unfriendly environment to the peace loving residents of this area.

    The kind of establishment currently being run from these premises, is also not conducive to the living environment of this area for the following reasons:

    • This establishment is being hired out as a party event where very powerful sound equipment is being used throughout the day, going in to late at night, depriving residents rest and disturbing the peace in a once very quiet neighborhood.

    • That when we residents complain about noise, we get threatened by patrons under the influence of alcohol.

    • That this establishment has brought in unnecessary traffic to an area and that it clearly states in the precinct plan that Observatory is a low density residential 1 area.

    • That this establishment has illegally created their own parking bays on the pavement outside, against city council and traffic rules without any city council consent. Usually when consent is granted for the use of a premise for the purpose of a lodge or a B&B, it clearly stipulates that parking must be provided inside the premises.

    • That police officers, Metro Police officers, had been called on several occasions to deal with the disturbances caused by this establishment.

    • That the local ward Councillor has been contacted on several occasions by the residents to assist with the disturbances caused by this property.

    • Documentation corroborating the claims as stated above, will be annexed to this petition upon submission.
